Telephone person Thea hung up on me while requesting I talk to a supervisor

I am pissed this young lady hung up. She didn't want to get in trouble so she hung up.

I am trying to add on Starz to my existing Prime video account. I have been trying on my own at Amazon.com. Chat is prompted by there is no way to enter text to state what I am trying to do.

It is after 6 pm EST and I have been trying to add Starz for over an hour! If this is the companies' way of customer sevrice IT SUCKS!!@!@

I tried watching NFL Thursday night 10/24 with Rams/Vikings matchup. Along with multiple buffering segments the broadcast seized up multiple times.

Then, the audio would continue with the screen frozen.

Sometimes the audio would drop out and the video would continue. I had to restart the program multiple times to get the same defects.

The NFL has always been horrible. It doesn't matter who covers or supplies the "games".

It won't get any better. Same old tired game, different cast of characters.

I can't play it or watch it ; when some rough stranger wants to knock me to the ground, I forget that it is supposed to be a "game" and become enraged and defensive enough to fight for my life. Same with wrestling ; try to hold me down and I'll go for the eyes.

Breach of contract, consumer fraud, deception, and other violations.

I have been a loyal subscriber to Amazon Prime Video, specifically opting for the premium subscription that promises an ad-free viewing experience. However, I have recently encountered repeated commercial interruptions during my streaming sessions, despite paying for the service that guarantees a commercial-free environment.

1.

Breach of Contract

By subscribing to Amazon Prime Video, I entered into an agreement with Amazon based on the express terms that the service would be ad-free. The inclusion of advertisements, despite this paid subscription, constitutes a breach of contract as outlined in the Uniform Commercial Code (UCC) Section 2-313. This section stipulates that when a seller makes an affirmation of fact or promise, it becomes part of the basis of the bargain, and failure to provide such promises leads to a breach of the contractual agreement.

2. False Advertising and Deceptive Practices

I believe Amazon is in violation of the Federal Trade Commission Act (15 U.S.C.

§ 45), which prohibits unfair or deceptive acts or practices in or affecting commerce. By advertising an ad-free service while providing advertisements to paying customers, Amazon is engaging in deceptive trade practices.

Additionally, under California Business and Professions Code § 17200 (or your state's equivalent), false advertising and deceptive business practices are prohibited. Amazons conduct may also violate state consumer protection laws that prevent businesses from misleading customers.

3. Consumer Fraud

This issue may also qualify as consumer fraud under the Consumer Fraud and Abuse Act (15 U.S.C.

§§ 41-58), as Amazon appears to be defrauding consumers by taking money for a service that is not being delivered as promised. As per Section 5(a) of the Federal Trade Commission Act, the representation that Amazon Prime Video would be ad-free is a material claim, and any deviation from this constitutes fraudulent activity, especially if it is done knowingly.

4. Unjust Enrichment

As a result of this practice, Amazon is unjustly enriching itself by collecting payments for a service it does not fully provide. This is an example of unjust enrichment, a legal concept under which one party retains a benefit it is not rightfully entitled to, especially if it results in harm to another party.

I am requesting a refund for the months I have been subjected to advertisements or, at the very least, a pro-rated refund for the amount paid for an ad-free service.

5. Violation of Consumer Rights and Protections

Furthermore, the ongoing deceptive practice may be infringing on my constitutional rights to be protected from fraudulent business practices. Under the Equal Protection Clause of the 14th Amendment and Commerce Clause of the U.S. Constitution, I am entitled to be treated fairly and not misled by false representations in commerce.

Relief Sought

I request that Amazon immediately address this issue by:

Providing a refund for the period during which advertisements were shown on my paid subscription.

Ensuring that no advertisements will be shown to me going forward, in accordance with the terms of the subscription I paid for.

Issuing a public correction regarding this deceptive practice.

If I do not receive an adequate response within [reasonable time frame, e.g., 15 days], I will consider pursuing legal action and filing a complaint with the Federal Trade Commission and other relevant consumer protection agencies. I will also be considering filing a claim under the Class Action Fairness Act (28 U.S.C. § 1332), as this issue may affect a large number of Amazon Prime Video subscribers.

Thank you for your prompt attention to this matter. I expect a full resolution in accordance with the terms of my subscription and relevant consumer protection laws.

Relevant Legal Citations & Laws:

Uniform Commercial Code (UCC) § 2-313: This statute covers implied warranties and the terms of contracts regarding sales and services.

Federal Trade Commission Act (15 U.S.C.

§ 45): Prohibits unfair or deceptive business practices.

Consumer Fraud and Abuse Act (15 U.S.C. §§ 41-58): Protects consumers against fraudulent actions in commerce.

State Consumer Protection Laws: Refer to your state's statutes (such as Californias Business and Professions Code § 17200) for specific prohibitions on deceptive practices.

Equal Protection Clause, 14th Amendment: Guarantees that individuals are not treated unfairly by the government or businesses in the market.

Commerce Clause, U.S. Constitution: Grants Congress the power to regulate interstate commerce, which includes oversight of fair business practices.

This is not the first time the Amazon has been caught conducting this kind of business Acts that are literally criminal. It ain't the first time that somebody has requested compensation and remedy

A mere refund is not acceptable.

Nor providing the prorate or any such thing like that would be acceptable at this point. These people need to know that they need to be held accountable and stop ripping people off committing fraud and other illegal Acts.

I will not accept anything less than damages, breach of contract, and for their other criminal and civil Acts.

They will also compensate on top of that for the months that I have been seeing commercials which has been for the past 3-4 months. They better not try and lowball me or any such thing because if they're not willing to work it out at this point I will pursue this in a court of law and I will win because they've settled over issues like this before and a court will accept the fact that they have known only willingly and totally committed these acts before and that they are continuously doing so.

Preferred solution: Compensation for the months that I was getting commercials Plus for the punitive damages or other damages caused by their illegal ax breach of contract etc. because of Prime membership in the additional fee for videos.

User's recommendation: Find another provider do not go to them. Find somebody who has competition cuz as long as they have competition you'll be guaranteed better services.

Amazon Prime has taken a dive in 2025. I am paying $139/year (was$119 two years ago) and now I have to watch ads interrupting my shows?

Not only that but the commercials volume goes way up. The last two months my packages have all been two days later than initially shown.

Sub par service. I do not think I will renew next month.

I'm considering getting rid of it. The commercials are so constant now and the buffering horrible. Mine finally froze up completely and when I called customer service the rep chewed food in my ear and finally just hung up, although she did send me a link to cancel

I'm cancelling Prime Video because fairly recent movies do not have closed captions. You find a good movie and can't hear it. The sound drowns out the speaking, and they want to charge 3 extra bucks for ad-free viewing.
